DREDGING CLAIM

 

During the Gulf War a Dredging Consortium was working in Iraq and was forced to complete the Works, before being released. Part of the final Contract Agreement was that the Consortium would forgo all claims and the Iraq Government all counter-claims. The Consortium were initially successful in Court arguing that their Insurers were liable for their additional costs, including the loss of their claims.

Maddrell Consultancy gave Expert Evidence in a subsequent Court Hearing, assessing all claims, based solely on information provided by the Consortium and what I could gain from a previous dredging contract and satellite imagery during the course of the works. This included an analysis of borehole logs, dredging rates, data on breakdowns, wear and tare etc.

The Insurance Company was able to greatly limit its exposure and subsequently there was a settlement out of Court.
